John Roberts has made a motion to accept the following Membership Rights
section to be included in the by-law requirements document:
Membership Rights
The following rights apply to all members equally, unless otherwise
prohibited by law. These rights cannot be limited or taken away by the
STARFLEET Board of Directors, or any other person in STARFLEET, except as
required by law.
Section 1 Rights:
- Right to due process.
- Right for all sides in an issue to be heard before decisions are made.
- Right to appeal all decisions rendered against you.
Section 2 Rights for members in Good Standing:
- Receiving a new, or renewing, membership packet and all of its contents
per annual membership.
- Be given access to six issues of the Communiqué per primary
subscription, per annual membership.
- Ability to specify the type of membership desired (single or family),
and the right to change from one type of membership to another for any
reason, without retribution. No refunds of membership dues will
accompany any kind of change in membership, pro-rated or otherwise unless
previously submitted funds have not yet been deposited by STARFLEET Finance.
- Access to due process and for all sides in an issue to be heard before
any judgment is made.
- Access to information about the availability of, and application
process for, any open position at any level of STARFLEET.
- One vote in the triennial STARFLEET International election, unless
otherwise prohibited by law or unavailable as part of membership class.
- Permission to voice your opinion at any level of STARFLEET.
- Participation in STARFLEET Academy to the extent wished.
- Ability to apply for any Chapter, Regional, or International position
you feel qualified to hold.
The Board of Directors reserves the right to add, withdraw, or otherwise
amend those rights specified in Section 2. Additional rights, as created by
the Board of Directors are to be approved by a majority vote of the Board of
Directors and, if approved, the newly created rights will be added to this
section of the By-Laws without further vote by the membership at large. The
Board of Directors also reserves the right to impose limitations, or remove
the rights (contained in Section 2), on a case-by-case individual basis for
members who have failed to fulfill their responsibilities of membership (or
are alleged *to have failed* to fulfill the responsibilities of membership)
at any time.
The Officers of the Corporation, or their designated person(s), team(s), or
committee(s), shall have the authority to temporarily limit or remove the
rights of any member (in Section 2), for any violations of policy previously
approved by the STARFLEET Board of Directors. (Section 2) Membership rights
may also be temporarily limited or removed upon allegations of failing to
fulfill the responsibilities of membership, as deemed necessary by the
Officers of the Corporation. The STARFLEET Board of Directors reserves the
rights to reinstate the rights previously limited or removed, upon the
outcome of a member’s appeal. The Officers of the Corporation also reserve
the right to reinstate rights previously limited or removed from a member on
a temporary basis.
For the scope of this section, temporarily shall mean from the time that the
action or offense is made or taken by a member, until the end of the appeals
process, heard by the entire STARFLEET Board of Directors.
Michael Conard has seconded this motion.
I now open the floor for further discussion. If there are no further
discussion points made within 48 hours on this topic then it will be moved
forward to a vote by the committee.
