Looks good, John.  Just one thing though, and one that I just thought of
too.

 

"The STARFLEET Board of Directors reserves the rights to create additional
rights, as stated in the Membership Handbook, and to remove those rights at
any time, either on a case-by-case individual basis or for all members when
a member has not fulfilled their responsibilities of membership."

 

I just noticed that this might be a little confusing the way I worded it.
The AB has the right to remove a right established in the MHB, at any time
and for any reason (because they created that right in the first place).
The way it's worded the AB can only remove a right in the MHB for all
members when they haven't fulfilled the responsibilities of their
membership.  I think we should clarify that one a little bit.

 

"The STARFLEET Board of Directors reserves the right to create additional
rights, as stated in the Membership Handbook, or to remove those rights.
They also reserve the right to impose limitations, or remove the rights, on
a case-by-case individual basis for members who have failed to fulfill their
responsibilities of membership (or are alleged of failing to fulfill the
responsibilities of membership) at any time."

 

I also noticed one other thing.  It's not really established IF a member has
actually failed to fulfill their membership rights, until they're given a
chance to end the appeals process.  I think that we should probably put the
"or are alleged of failing to fulfill the responsibilities of membership"
disclaimer in the EC section as well, to prevent someone from allowing the
EC to limit/remove the rights of someone who's going through the process.  

 

That way the EC could determine, "Hey Joe Sare has the answers for OTS on
otsanswers.com.  Let's temporarily remove his right to attend the academy to
the full extent wished until the AB can hear the issue, and decide this for
themselves."  Or another example.  "Hey Joe Sare seems to harassing Dave
Blaser and John Roberts on the official list.  Let's remove him from the
list for 3 months to prevent him from doing so, and only allow him back on
the list with the understanding that he doesn't harass anybody else."
Because the official list policy is something that the AB has approved
previously, so the EC (or list moderators since the EC gave them the power
to enforce the list rules) could temporarily take one of my rights away
(assuming that is still listed as a right in the new MHB to participate to
the extent wished.)

I agree with Joe's comments made earlier on this subject.  I have taken the
liberty of culling his ciomments into the following to start our discussions
on Membership Rights:
 

Membership Rights

The following rights apply to all members equally, unless otherwise
prohibited by law.  These rights cannot be limited or taken away by the
STARFLEET Board of Directors, or any other person in STARFLEET, except as
set forth in these By-Laws.

 

. Right to due process. 

. Right for all sides in an issue to be heard before judgment is passed. 

. Right to appeal all judgmental decisions.

 

The STARFLEET Board of Directors reserves the rights to create additional
rights, as stated in the Membership Handbook, and to remove those rights at
any time, either on a case-by-case individual basis or for all members when
a member has not fulfilled their responsibilities of membership.  Any policy
of STARFLEET, which would automatically result in the limitation or
exclusion of any rights for any member, shall be approved by majority vote
of the STARFLEET Board of Directors before it is implemented. 

 

The Officers of the Corporation, or their designated person(s), team(s), or
committee(s), shall have the authority to temporarily limit or remove the
rights of any member, for any violations of policy previously approved by
the STARFLEET Board of Directors.  Only the STARFLEET Board of Directors can
reinstate the rights previously limited or removed, upon the outcome of a
member's appeal.  For the scope of this section, temporarily shall mean from
the time that the action or offense is made or taken by a member, until the
end of the appeals process, heard by the entire STARFLEET Board of
Directors.
